What Is Legal Communication?
- by siteadmin
A legal person is someone who works in the legal profession. They have to follow the law and can be arrested if they don't.
Legal jurisprudence is the study of the rules of the law and how they apply to people and their behavior. This is an interdisciplinary field that combines knowledge from the sciences and the humanities.
Legal Writing
Legal writing is the art of communicating information with clarity and accuracy. It includes a range of writing styles, from simple business letters to complex, technical documents.
It is a skill that requires practice and development, much like any other writing craft. The best legal writers are aware of their audience, understand the appropriate style for that audience, and strive to write in that preferred style.
Good legal writing adheres to accepted standards of form and tone. It avoids legal jargon and uses plain language that is idiomatic and clear.
Most students’ legal writing skills improve over the course of law school. Selecting a sample that is sufficiently recent to demonstrate your current skills gives employers confidence that you will continue to improve as a writer, analyst, and advocate.
Legal Research
Legal research is the process of gathering information about the law. This may include statutes, regulations, case law, and secondary sources (such as legal encyclopedias and treatises).
Many lawyers conduct their own legal research, but it can be a daunting task. Without a clear, defined plan, many researchers end up lost, frustrated, and confused.
Start by identifying the legal problem you’re trying to solve, along with your ideal outcome. This will help you focus your research efforts and prevent you from spending unnecessary time.
Next, consider what type of law you’re looking for. Statutes, which are laws enacted by Congress or state legislatures, are often the first place to start. Annotated codes, which combine statutory language with citations to cases, regulations, secondary sources, and other statutes, are especially useful.
Remember to keep your research up to date, as laws change. Even if you’ve found useful cases in the past, they might be overruled or unconstitutional now. It’s also important to update your research as new court opinions are issued, so you can stay on top of the latest developments in your field.
Legal Analysis
Legal analysis is the process of applying the law to facts. It is a key part of every memorandum, brief, and case statement written by paralegals and lawyers.
A well-written analysis follows a structured methodology called IRAC, which stands for Issue, Rule, Application, and Conclusion. If you take the time to discipline yourself to utilize each of these steps, the end result will be a product that an attorney will recognize and respect.
When writing your analysis, you must begin each paragraph with a topic sentence and only discuss cases and facts that relate to the issue at hand. This will make your writing clearer and more convincing.
LARW faculty integrate research instruction into the first-year program and work closely with reference librarians to help students learn to locate relevant print and electronic resources. The program also places a strong emphasis on hands-on learning through group activities and workshops.
Legal Communication
Legal communication is a critical element of law firm success. It enables clients to feel heard and cared for, enabling them to make informed decisions about their cases.
It also helps ensure that your firm is compliant with ethics rules, so it’s vital to keep this area of client service at the top of your priority list. Using communication tools such as secure portals can help you meet this goal more efficiently and effectively.
Empathy is another key element of good client communications. It can be developed through sharpening your interpersonal skills, such as watching for visual cues, staying present, and asking probing questions when you sense there may be more to the story than meets the eye.
